1. Terms

1. 1.1These Terms are an agreement between you and DreamerLab and apply to the DreamerLab app, website and any features provided through them.
2. 1.2You agree to these Terms when you create an account or first use the Services.
3. 1.3If you do not agree to these Terms, you must not use the Services or download the DreamerLab app, and you must delete your account if you have already made one.

2. Accounts

1. 2.1An account is required to use DreamerLab. You sign in with Google, Apple or Discord.
2. 2.2Your DreamerLab account, Credits and Power may also work in our other apps that use the same account. Deleting your account deletes it in all of them.
3. 2.3You must be at least 13 years old to use DreamerLab. If the law where you live sets a higher minimum age for using online services without a parent’s consent, you must be at least that age or have your parent’s or legal guardian’s consent.
4. 2.4If you are under 18, or under the age of majority where you live, you may only use DreamerLab and make purchases with the permission of a parent or legal guardian. Your parent or guardian accepts these Terms on your behalf and is responsible for your use of DreamerLab, including any purchases.
5. 2.5You may not share your account with any other person or entity, nor transfer your account to anyone else. You must keep the logins connected to your account reasonably secure.
6. 2.6You are responsible for all actions and requests made through your account, and must make sure they do not violate these Terms.
7. 2.7We may suspend or terminate your account at any time if you violate these Terms.
8. 2.8If your account is terminated or deleted, we do not guarantee that your data will remain available, and purchases or subscriptions are not refunded except where required by law or by the app store’s policies.

3. Purchases, DreamerLab Pro, Credits and Power

1. 3.1DreamerLab is free to download. Some features use Credits or Power, which are virtual items held in your account. DreamerLab Pro is an optional subscription with the benefits described in the app at the time of purchase, such as daily Credits, monthly Power, access to every feature and no ads.
2. 3.2Purchases and subscriptions are processed by the Apple App Store or Google Play and are also subject to their terms. Prices are shown in the app before you buy.
3. 3.3Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before renewal in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription. If a free trial is offered, it becomes a paid subscription unless you cancel before it ends.
4. 3.4Credits and Power may only be used for features in DreamerLab, and in our other apps that accept them. We may change how many Credits or Power a feature uses.
5. 3.5Credits and Power have no cash value and are not redeemable for cash or for any other goods or services.
6. 3.6Credits and Power may not be given or transferred to any other user.
7. 3.7When offered, Credits may also be earned by watching a rewarded ad. The reward is added after the ad network confirms the view.
8. 3.8If an AI Portrait or another request that uses Credits or Power fails, the Credits or Power it used are returned to your account.
9. 3.9All purchases are final and non-refundable, unless otherwise required by law or by the app store’s policies. Refund requests are handled by Apple or Google. Repeated refund requests without valid justification, or attempts to abuse refunds, may result in account suspension or termination at our sole discretion.

4. Your photos and edits

1. 4.1You keep all rights to the photos you edit. DreamerLab makes no claims on the ownership or copyright of your edits or of images generated with AI, and you may freely use what you create, subject to these Terms and the law.
2. 4.2You must own, or have the right to use, every photo you edit, including the permission of the people who appear in it.
3. 4.3You give us a limited, worldwide, royalty-free licence to process the photos you submit, only as needed to provide the feature you asked for. We do not publish your photos.
4. 4.4Works in My Edits are stored on your device and are not backed up by us. Deleting the app or clearing its data removes them. Save anything you want to keep to your photo library.

5. AI features and AI Portraits

1. 5.1Some features use AI models, including models run by third-party providers for AI Portraits. AI output may be unpredictable, may change how a person looks, and is not guaranteed to match the chosen style or to be of any given nature or quality.
2. 5.2Only use AI Portraits and other AI features on photos of yourself, or of people who have clearly agreed to it.
3. 5.3Do not upload photos of a child unless you are that child or their parent or legal guardian, and never use AI features to create sexual or suggestive images of anyone under 18.
4. 5.4We or our providers may refuse a request that appears to break these Terms. A refused AI Portrait does not use your Power.
5. 5.5Do not attempt to generate content that is illegal where you live.
6. 5.6Do not access our AI services by any means other than the DreamerLab app.

6. Content guidelines

By using DreamerLab, you agree to follow these rules:

6.1 The golden rule: respect and consent

• No non-consensual content. Do not use our tools to create images of real people without their explicit consent. This includes “deepfakes” and misleading depictions of public figures, celebrities or private individuals.
• Respect privacy. Do not create or share content that reveals other people’s private or personal information.

6.2 Zero tolerance for harmful content

• Child sexual abuse material (CSAM). We have a zero-tolerance policy for any content that sexualises or exploits minors. We report such content to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.
• Sexual violence and non-consensual intimate imagery. Content depicting sexual violence, non-consensual sexual acts or non-consensual intimate imagery (NCII) is strictly forbidden.
• Illegal acts. Do not use DreamerLab to promote, facilitate or depict illegal activities.
• Self-harm. Do not create content that encourages or promotes self-harm, suicide or eating disorders.
• Graphic violence. Do not create content that is excessively gory or depicts realistic violence against people or animals.

6.3 Hate speech and harassment

• No hate speech. Do not create content that promotes violence, incites hatred or dehumanises people based on race, ethnicity, religion, disability, gender, age, nationality, veteran status or sexual orientation.
• No bullying. Do not use edited or generated images to harass, bully, shame or intimidate anyone.

6.4 Misinformation and deception

• No disinformation. Do not use DreamerLab to create misleading content intended to deceive the public, influence elections or spread false information about significant public events.
• Disclosure. When you share a realistic AI-generated image, we encourage you to say that it was made with AI.

7. Restrictions of conduct

In accessing and using DreamerLab, you agree that:

1. You will not modify, translate, adapt or reformat DreamerLab.
2. You will not decipher, decompile, disassemble or reverse-engineer DreamerLab, or otherwise attempt to discover the source code or structure of its software or materials.
3. You will not interfere with or circumvent any security feature of DreamerLab, or any feature that limits or charges for its use, including Credits, Power, Pro and usage limits.
4. You will not use DreamerLab to gain unauthorised access to our or any third party’s data, systems or networks.
5. You will not use bots, scripts or other automated means to access DreamerLab or its servers.
6. You will not use DreamerLab in any manner that could damage, disable, overburden, impair or otherwise interfere with our systems and networks, or with other users’ use of DreamerLab.
7. You will not use DreamerLab in any way that, in our sole discretion, may expose us or others to liability or damages.
8. You will not remove, change or obscure any copyright, trademark or other proprietary notice contained in DreamerLab.
9. You will comply with all applicable laws in your access and use of DreamerLab, including the laws of your country or district.

8. Ads and third-party services

1. 8.1The free version of DreamerLab shows ads from Google AdMob and its partner networks. You can review your ad privacy choices in Settings. DreamerLab Pro removes ads.
2. 8.2DreamerLab works with third-party services, including the Apple App Store, Google Play, Google, Apple and Discord sign-in, and AI providers. Your use of them may be subject to their own terms and policies. We do not guarantee that third-party apps, services or devices will be compatible with DreamerLab.

9. Availability and changes

1. 9.1We try to keep DreamerLab reliable and available on as many devices as possible, but we do not guarantee any level of availability or uptime.
2. 9.2We may add, change, suspend or remove features, styles, effects and templates at any time.
3. 9.3We may change these Terms at any time. We will update the date at the top of this page and, for significant changes, try to notify you in the app. If you keep using DreamerLab after a change, you accept the updated Terms.

10. Liability

The DreamerLab services are provided to you on an “as is” and “as available” basis, and your use of them is at your sole risk. To the fullest extent permitted by law, we make no and disclaim all representations or warranties of any kind, express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement and title.

We do not warrant that:

1. DreamerLab, or the results obtained from using it, will be timely, error-free, secure or uninterrupted;
2. DreamerLab will meet your requirements;
3. any edit or AI-generated image will be accurate, reliable or of any particular quality; or
4. any errors or malfunctions in the DreamerLab app or website will be corrected.

To the fullest extent permitted by law, we shall in no event be responsible or liable to you or to any third party, whether under contract, warranty, tort (including negligence), strict liability, indemnity or any other theory, for any direct, indirect, special, incidental, consequential, exemplary or punitive damages, or any other damages, including loss of profit, revenue, data or business, arising in whole or in part from your use of (or inability to use) DreamerLab, even if we have been advised of the possibility of such damages. We are not liable for any delay or failure in performance caused by events beyond our reasonable control.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded or limited by contract.
